A will dispute arises when someone challenges the validity of a will or the way an estate is being administered or distributed. Disputes often arise where family members or beneficiaries believe a will does not reflect the true intentions of the person who died, or feel they have been unfairly left out.

We advise on your rights and options, whether you are contesting or defending a will.

When Do Will Disputes Arise?

Will disputes commonly occur when family members or beneficiaries feel the will was made under unfair circumstances, or when they question whether it meets legal requirements. Disputes can also arise if a previous promise or inheritance expectation was not honoured.

Our solicitors can assess your situation and explain whether you have a valid claim or defence.

Common Causes of Will Disputes

  • Lack of Mental Capacity: The person making the will (the testator) did not have the mental capacity required to make it.
  • Undue Influence: The testator was pressured or coerced into making or changing the will.
  • Fraud or Forgery: The will was tampered with or falsely signed.
  • Improper Execution: The will does not meet the legal signing or witnessing rules.
  • Disputed Promises: Someone was promised an inheritance, relied on that promise to their detriment, and was not provided for.
  • Inheritance Act Claims: The will, or the intestacy rules, do not make reasonable financial provision for a spouse, child or dependant.

What Happens When a Will Is Contested?

When a will is contested, both sides are encouraged to take early legal advice. Many disputes are settled through negotiation or mediation, avoiding lengthy and expensive court proceedings. If agreement cannot be reached, the matter may proceed to a claim in the High Court.
